By filing dozens of overlapping patents and suing again and again to block lower-cost generics, brand-name drug companies keep prices high and competition out. This serial patent litigation delays access to affordable medicines and costs patients, families, employers, and taxpayers billions every year.
It’s time for Congress to act.
We’re calling on lawmakers to:
- Enact a “use it or lose it” rule to stop companies from holding back patents in initial lawsuits and then using them to bully generics manufacturers with serial litigation.
- Limit legal threats that help Big Pharma intimidate generics manufacturers and delay competition.
